To qualify to adopt you must be over the age of 18 and married to the biological parent of the child. Also, both biological parents must consent to the adoption in writing. If the non-custodial parent is under the age of 18, his or her parents or guardians must also agree to the adoption.
Under certain circumstances, consent is not required:
- If the other parent is dead
- If the other parent is not competent to consent
- If the child has been abandoned by the other parent and there has been no contact whatsoever for 365 days
- If the child's "putative father" cannot be located through the Ohio Putative Father Registry
- If the parental rights of the "other" parent have been terminated
It is also important to know that if the child to be adopted is older than 14, she or he must also consent in writing to being adopted.
